These Terms and Conditions ("Terms") govern the use of the website operated by Nojudu and the booking of Active Leisure Program services offered through it. By placing an order or otherwise using this website, the visitor ("Customer") accepts these Terms in full. These Terms are drafted in accordance with the Polish Civil Code (Kodeks cywilny) and the Act of 30 May 2014 on Consumer Rights (Ustawa o prawach konsumenta), which govern the legal relationship between the parties.

2. Placing and Confirming an Order

Orders for Active Leisure Program services may be placed through the website's booking form, by email, or by telephone. An order constitutes an offer by the Customer to purchase the selected activity or package.

A contract between the Customer and Nojudu is formed only once Nojudu sends a written confirmation to the email address provided by the Customer at the time of booking. This confirmation will specify the date, scope, and price of the reserved activity. Nojudu reserves the right to decline an order, for example where availability, weather conditions, or safety requirements do not permit the service to be delivered as requested; in such cases any payment already made will be refunded in full.

3. Prices, Payment and Inclusions

All prices displayed on the website are quoted in Polish złoty (PLN) and include applicable value-added tax (VAT) unless stated otherwise. The price confirmed in the order confirmation is binding for that specific booking.

The price does not include transport to the venue, personal insurance, meals, or accommodation, unless explicitly stated in the offer. Payment may be made by the methods indicated at checkout, including bank transfer or online payment, prior to the confirmed activity date, unless a different arrangement has been agreed in writing.

4. Cancellation and Complaints

4.1 Right of Withdrawal

Where the Customer is a consumer within the meaning of Polish law and the contract is concluded at a distance, the Customer generally has the right to withdraw from the contract within 14 days without giving any reason, in accordance with the Act on Consumer Rights. This right does not apply to services related to leisure activities where the contract specifies a particular date or period of performance, as provided under Article 38(12) of that Act, given the nature of scheduled outdoor and recreational activities.

4.2 Cancellation by the Customer

Where withdrawal is not applicable due to a fixed activity date, cancellation requests should be sent to [email protected] as early as possible. Refund conditions depend on how much notice is given before the scheduled activity, as specified in the order confirmation.

4.3 Complaints

Complaints regarding the quality or performance of a service may be submitted by email to [email protected] or by post to the company address. Complaints should include the order details and a description of the issue. Nojudu will respond within 14 calendar days of receipt. Consumers may also seek assistance from the relevant Polish consumer protection bodies, including the President of the Office of Competition and Consumer Protection (UOKiK), or use the EU Online Dispute Resolution platform where applicable.

5. Limitation of Liability

Nojudu takes reasonable care to ensure that activities are conducted safely and as described. However, participation in active leisure activities carries inherent risks, and Customers participate at their own risk, following all safety instructions given by staff.

Nojudu's liability is limited to direct damages resulting from proven fault or negligence in the performance of its services, up to the value of the relevant booking, except where liability cannot be limited under mandatory provisions of Polish law, including liability for personal injury caused intentionally or through gross negligence.

Nojudu is not liable for delays, cancellations, or changes caused by circumstances beyond its reasonable control, including adverse weather, force majeure, or decisions of public authorities.

6. Cookies and Privacy

This website uses a single cookie, named gdpr_consent, which stores the Customer's cookie consent choice for a period of one year. This website does not use any analytics, tracking, or session cookies. Advertising measurement tools are activated only after the Customer has given consent, and only on the order confirmation page.

Where required, Customers also have the right to lodge a complaint with the Polish supervisory authority, the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych, UODO).

7. Governing Law

These Terms are governed by the laws of Poland. Any disputes arising from these Terms shall be submitted to the competent Polish courts, without prejudice to any mandatory consumer protection rights available under the Customer's own place of residence within the European Union.
